Public Hearing and Second Reading of Expanded Polystyrene Ban in Avon on January 28th
Avon, CO – Avon Town Council will conduct a public hearing on January 28, 2020, on the Second Reading of Ordinance No. 19-11 Expanded Polystyrene Ban. The public hearing will be held at Avon Town Hall, 100 Mikaela Way, Avon, CO, at 5:00 p.m. or as soon as possible thereafter. Please see the final agenda for an indication of a more specific time for this agenda item.
Avon Town Council passed First Reading of Ordinance No. 19-11 on November 19, 2019. If enacted, Ordinance No. 19-11 would prohibit food vendors from using disposable food service ware made of expanded polystyrene (i.e. Styrofoam) when providing prepared food to their patrons by adopting a new Chapter 8.50 of Title 8 of the Avon Municipal Code Establishing Provisions Regarding Ban on Use of Polystyrene Foam. On January 8, 2020, Senator Kerry Donovan and Representatives Meg Froelich and Alex Valdez introduced Senate Bill 20-010, Repeal Ban on Local Government Regulation of Plastics. If passed, this Senate Bill would clarify that local governments have the legal authority to regulate plastics, including expanded polystyrene. Ordinance No. 19-11 expressly states that it does not take effect unless and until the Colorado Statutes are revised to clarify that local governments have the authority to regulate plastics.
Public comments are welcomed and encouraged for this public hearing. The Town Council will receive comments at the public hearing at the January 28th Town Council meeting.
